{"id":97300,"date":"2026-01-22T21:02:50","date_gmt":"2026-01-22T21:02:50","guid":{"rendered":"https:\/\/everyday.ng\/?p=97300"},"modified":"2026-01-22T21:02:50","modified_gmt":"2026-01-22T21:02:50","slug":"rivers-high-court-order-halts-impeachment-probe-as-chief-judge-refuses-to-constitute-panel","status":"publish","type":"post","link":"https:\/\/everyday.ng\/?p=97300","title":{"rendered":"Rivers High Court order halts impeachment probe as Chief Judge refuses to constitute panel"},"content":{"rendered":"<p><span style=\"font-size: 17px;\"><b>The Chief Judge of Rivers State, <\/b><\/span><span style=\"font-size: 17px;\"><b>Justice Simeon Chibuzor Amadi<\/b><\/span><span style=\"font-size: 17px;\">, has officially declined to constitute a judicial panel to investigate Governor <\/span><span style=\"font-size: 17px;\"><b>Siminalayi Fubara<\/b><\/span><span style=\"font-size: 17px;\"> and his deputy, <\/span><span style=\"font-size: 17px;\"><b>Prof. Ngozi Nma Odu<\/b><\/span><span style=\"font-size: 17px;\">, over allegations of gross misconduct, citing extant court orders that legally bar him from doing so. <\/span><\/p>\n<p><span style=\"font-size: 17px;\">In a letter dated <\/span><span style=\"font-size: 17px;\"><b>January 20, 2026<\/b><\/span><span style=\"font-size: 17px;\"> and addressed to <\/span><span style=\"font-size: 17px;\"><b>Rt. Hon. Martin Amaewhule<\/b><\/span><span style=\"font-size: 17px;\">, Speaker of the Rivers State House of Assembly, Justice Amadi explained that his hands are \u201cfettered\u201d by <\/span><span style=\"font-size: 17px;\"><b>two interim injunctions<\/b><\/span><span style=\"font-size: 17px;\"> served on his office on <\/span><span style=\"font-size: 17px;\"><b>January 16<\/b><\/span><span style=\"font-size: 17px;\"> following suits filed separately by the governor and his deputy. Those orders, issued by a High Court sitting in Port Harcourt, expressly restrain him from <\/span><span style=\"font-size: 17px;\"><i>receiving, forwarding, considering or acting on any request, resolution or communication relating to impeachment proceedings<\/i><\/span><span style=\"font-size: 17px;\">. <\/span><\/p>\n<p><span style=\"font-size: 17px;\">The injunctions were obtained to forestall the impeachment process initiated by the state legislature and specifically name the Chief Judge in their operative provisions. Justice Amadi noted in his letter that the Speaker has already lodged an appeal against the injunctions at the <\/span><span style=\"font-size: 17px;\"><b>Court of Appeal in Port Harcourt<\/b><\/span><span style=\"font-size: 17px;\">, and that the doctrine of <\/span><span style=\"font-size: 17px;\"><i>lis pendens<\/i><\/span><span style=\"font-size: 17px;\"> requires all parties and courts to await the outcome of that appeal before moving forward. <\/span><\/p>\n<p><span style=\"font-size: 17px;\">\u201cBy virtue of the subsisting interim orders of injunction and the appeal, <\/span><span style=\"font-size: 17px;\"><b>my hand is fettered<\/b><\/span><span style=\"font-size: 17px;\">,\u201d the Chief Judge wrote, adding that he is \u201clegally disabled at this point\u201d from exercising his constitutional powers under Section 188(5) of the Nigerian Constitution. <\/span><\/p>\n<p><span style=\"font-size: 17px;\">He urged the Rivers State House of Assembly to \u201cbe magnanimous enough to appreciate the legal position of the matter,\u201d stressing that the rule of law must prevail despite the political pressure surrounding the issue. <\/span><\/p>\n<p><span style=\"font-size: 17px;\">The current stalemate follows an impeachment effort launched by the Rivers State House of Assembly on <\/span><span style=\"font-size: 17px;\"><b>January 8, 2026<\/b><\/span><span style=\"font-size: 17px;\">, when lawmakers cited allegations of budgetary impropriety, failure to present the 2026 appropriation bill, unauthorized expenditure of public funds and withholding statutory allocations to the legislature as grounds for gross misconduct against Governor Fubara and Deputy Governor Odu. <\/span><\/p>\n<p><span style=\"font-size: 17px;\">On <\/span><span style=\"font-size: 17px;\"><b>January 16<\/b><\/span><span style=\"font-size: 17px;\">, the Assembly passed a motion requesting that the Chief Judge constitute a <\/span><span style=\"font-size: 17px;\"><b>seven-member judicial panel<\/b><\/span><span style=\"font-size: 17px;\"> to investigate the allegations. However, the High Court injunction has since prevented any action on that motion. <\/span><\/p>\n<p><span style=\"font-size: 17px;\">The refusal by Justice Amadi to set up the panel adds another layer to the tense legal and political conflict in Rivers State, where the impeachment process is now in limbo pending the appeal.
