{"id":96869,"date":"2025-12-29T17:30:24","date_gmt":"2025-12-29T17:30:24","guid":{"rendered":"https:\/\/everyday.ng\/?p=96869"},"modified":"2025-12-29T17:30:24","modified_gmt":"2025-12-29T17:30:24","slug":"atiku-nba-civil-society-push-back-as-fg-insists-on-controversial-tax-laws-amid-constitutional-row","status":"publish","type":"post","link":"https:\/\/everyday.ng\/?p=96869","title":{"rendered":"Atiku, NBA, civil society, push back as FG insists on controversial tax laws amid constitutional row"},"content":{"rendered":"<p><span style=\"font-size: 16px;\"><b>Former Vice President <\/b><\/span><span style=\"font-size: 16px;\"><b>Atiku Abubakar<\/b><\/span><span style=\"font-size: 16px;\"> has joined a broadening coalition of legal bodies, opposition figures and civil society groups in challenging the Federal Government\u2019s insistence on the imminent implementation of Nigeria\u2019s newly enacted tax laws, as controversies mount over alleged forgery and discrepancies between the versions of the laws passed by the National Assembly and the versions officially gazetted.<\/span><\/p>\n<p><span style=\"font-size: 16px;\">The dispute centres on allegations that the <\/span><span style=\"font-size: 16px;\"><b>gazetted editions of the 2025 Tax Reform Acts<\/b><\/span><span style=\"font-size: 16px;\"> \u2014 including the <\/span><span style=\"font-size: 16px;\"><i>Nigeria Tax Act, Nigeria Tax Administration Act, Nigeria Revenue Service (Establishment) Act<\/i><\/span><span style=\"font-size: 16px;\"> and the <\/span><span style=\"font-size: 16px;\"><i>Joint Revenue Board (Establishment) Act<\/i><\/span><span style=\"font-size: 16px;\"> \u2014 <\/span><span style=\"font-size: 16px;\"><b>differ materially from the versions debated and approved by the National Assembly<\/b><\/span><span style=\"font-size: 16px;\"> before being signed into law by President Bola Ahmed Tinubu. <\/span><\/p>\n<p><b><span style=\"font-size: 19px;\">Constitutional Crisis Over Gazetted Laws<\/span><\/b><\/p>\n<p><span style=\"font-size: 16px;\">In a fiery statement issued on Sunday, Atiku Abubakar argued that the confirmations of discrepancies by the Senate \u201c<\/span><span style=\"font-size: 16px;\"><b>raise a grave constitutional issue<\/b><\/span><span style=\"font-size: 16px;\">,\u201d stressing that under <\/span><span style=\"font-size: 16px;\"><b>Section 58 of the 1999 Constitution<\/b><\/span><span style=\"font-size: 16px;\">, a bill becomes law only after passage by both chambers of the National Assembly, presidential assent and publication in the Official Gazette \u2014 in that order. He emphasised that <\/span><span style=\"font-size: 16px;\"><b>gazetting is merely administrative<\/b><\/span><span style=\"font-size: 16px;\"> and <\/span><span style=\"font-size: 16px;\"><i>cannot<\/i><\/span><span style=\"font-size: 16px;\"> amend, validate or cure defects in the law-making process. <\/span><\/p>\n<p><span style=\"font-size: 16px;\">Atiku described the situation as tantamount to <\/span><span style=\"font-size: 16px;\"><b>forgery<\/b><\/span><span style=\"font-size: 16px;\"> when \u201cpost-passage insertions, deletions or modifications\u201d are made without legislative approval. He warned that any attempt to \u201crush a re-gazetting\u201d without fresh legislative passage and presidential assent would undermine parliamentary oversight, set a dangerous precedent and further erode constitutional governance. <\/span><\/p>\n<p><b><span style=\"font-size: 19px;\">National Assembly Orders Re-Gazette, Lawmakers Demand Transparency<\/span><\/b><\/p>\n<p><span style=\"font-size: 16px;\">The leadership of the National Assembly, under Senate President <\/span><span style=\"font-size: 16px;\"><b>Godswill Akpabio<\/b><\/span><span style=\"font-size: 16px;\"> and Speaker <\/span><span style=\"font-size: 16px;\"><b>Tajudeen Abbas<\/b><\/span><span style=\"font-size: 16px;\">, has acknowledged the controversy, <\/span><span style=\"font-size: 16px;\"><b>ordering the re-gazetting of the tax Acts and the issuance of certified true copies of the versions duly passed by both chambers<\/b><\/span><span style=\"font-size: 16px;\">. This move is aimed at clarifying legislative intent and addressing public concerns over the legislative record. <\/span><\/p>\n<p><span style=\"font-size: 16px;\">However, the process has itself drawn criticism. Some lawmakers expressed outrage after reports that Akpabio instructed the Clerk of the National Assembly <\/span><span style=\"font-size: 16px;\"><b>not to release copies of the assented tax law<\/b><\/span><span style=\"font-size: 16px;\"> to legislators, prompting further claims of opacity in the handling of the matter. <\/span><\/p>\n<p><b><span style=\"font-size: 19px;\">Legal Bodies, Opposition Calls for Suspension and Probe<\/span><\/b><\/p>\n<p><span style=\"font-size: 16px;\">The <\/span><span style=\"font-size: 16px;\"><b>Nigerian Bar Association (NBA)<\/b><\/span><span style=\"font-size: 16px;\"> has joined Atiku in calling for the <\/span><span style=\"font-size: 16px;\"><b>immediate suspension of the implementation of the tax laws<\/b><\/span><span style=\"font-size: 16px;\">, urging a full and transparent investigation into how the alleged alterations occurred. The NBA said the controversy \u201craises grave concerns about the integrity, transparency and credibility of Nigeria\u2019s legislative process.\u201d <\/span><\/p>\n<p><span style=\"font-size: 16px;\">Other political voices, including former Senate Leader <\/span><span style=\"font-size: 16px;\"><b>Ali Ndume<\/b><\/span><span style=\"font-size: 16px;\">, have urged President Tinubu to <\/span><span style=\"font-size: 16px;\"><b>suspend the planned January 1 rollout<\/b><\/span><span style=\"font-size: 16px;\"> of the laws pending resolution of the dispute. Additional organisations and opposition parties, such as the <\/span><span style=\"font-size: 16px;\"><b>African Democratic Congress (ADC)<\/b><\/span><span style=\"font-size: 16px;\">, have called for public inquiries and even the <\/span><span style=\"font-size: 16px;\"><b>prosecution of officials found to have tampered with the legislative text<\/b><\/span><span style=\"font-size: 16px;\">. <\/span><\/p>\n<p><b><span style=\"font-size: 19px;\">Federal Government Maintains Implementation Schedule<\/span><\/b><\/p>\n<p><span style=\"font-size: 16px;\">Despite the mounting criticism, government officials, including the <\/span><span style=\"font-size: 16px;\"><b>Minister of Information and National Orientation<\/b><\/span><span style=\"font-size: 16px;\">, have insisted there is only one authentic version of the tax laws and that they followed due process. The government has reaffirmed that the laws <\/span><span style=\"font-size: 16px;\"><b>will take effect from January 1, 2026<\/b><\/span><span style=\"font-size: 16px;\">, as originally scheduled. <\/span><\/p>\n<p><span style=\"font-size: 16px;\">Meanwhile, the Chairman of the Presidential Committee on Fiscal Policy and Tax Reforms, <\/span><span style=\"font-size: 16px;\"><b>Taiwo Oyedele<\/b><\/span><span style=\"font-size: 16px;\">, has disputed claims that the tax laws differ from what was passed, noting complications in obtaining certified copies of the harmonised versions for comparison. <\/span><\/p>\n<p><span style=\"font-size: 16px;\">Legal and policy analysts warn that the episode could have far-reaching implications for Nigeria\u2019s democratic institutions, potentially undermining public trust, investor confidence, and adherence to the separation of powers.
