{"id":66652,"date":"2023-09-22T21:21:28","date_gmt":"2023-09-22T21:21:28","guid":{"rendered":"https:\/\/everyday.ng\/?p=66652"},"modified":"2023-09-22T21:21:28","modified_gmt":"2023-09-22T21:21:28","slug":"tinubus-academic-records-us-court-accedes-to-request-to-stand-down-release-to-atiku","status":"publish","type":"post","link":"https:\/\/everyday.ng\/?p=66652","title":{"rendered":"Tinubu&#8217;s academic records: US court accedes to request to stand down release to Atiku"},"content":{"rendered":"<p><span style=\"font-size: 19px;\">A U.S. District Judge Nancy Maldonado, has stood down an order by another judge, asking that the academic records of President Bola Tinubu be released by the Chicago State University to his political rival, former Vice President Atiku Abubakar.<\/span><\/p>\n<p><span style=\"font-size: 19px;\">The documents were meant to have been released and sworn to by the University on Thursday night; but <\/span><span style=\"font-size: 19px;\">Tinubu filed an Emergency Motion urging the Chicago Court to postpone the release of his academic records until at least Monday, September 25th.<\/span><\/p>\n<p><span style=\"font-size: 19px;\">An emergency hearing held on Thursday saw Judge Maldonado instruct attorneys from both parties to file additional arguments by the upcoming Thursday.<\/span><\/p>\n<p><span style=\"font-size: 19px;\">The legal team representing the Nigerian President contended that Gilbert\u2019s decision needed a thorough review by a district judge.<\/span><\/p>\n<p><span style=\"font-size: 19px;\">Maldonado approved their request, stating she would expedite a ruling following the review.<\/span><\/p>\n<p><span style=\"font-size: 19px;\">\u201cI will have a busy weekend. The issue is of process and rules. I\u2019m a rule person; that\u2019s why I\u2019m a judge. This case is quite involved. I am aware of the stakes. It\u2019s more important to me to get this right,\u201d she said.<\/span><\/p>\n<p><span style=\"font-size: 19px;\">Everyday.ng reports that Tinubu, uncomfortable with the United States Magistrate Court\u2019s order directing Chicago State University to release his academic records to Atiku, had filed an application with the District Court to halt the order\u2019s implementation.<\/span><\/p>\n<p><span style=\"font-size: 19px;\">The magistrate court had given Chicago University 48 hours to release Tinubu\u2019s records to Atiku.<\/span><\/p>\n<p><span style=\"font-size: 19px;\">Rattled by the court order, alleged in a fresh application on Thursday that the Magistrate breached the constitution by acting as a final court in such matters of discovery.<\/span><\/p>\n<p><span style=\"font-size: 19px;\">The jittery President Tinubu contended that a Magistrate should only report and recommend to the district judge in such matters.<\/span><\/p>\n<p><span style=\"font-size: 19px;\">Tinubu further argued that the Magistrate court had issued what seemed to be a final order on September 19, demanding immediate compliance starting on September 21.<\/span><\/p>\n<p><span style=\"font-size: 19px;\">\u201cIntervenor asks this court to enter an immediate order delaying the effect of the Magistrate\u2019s order, at least until Monday, September 25, 2023, so the court may fully consider both the scope of the Magistrate\u2019s authority to issue the order without review and the issue of whether the Magistrate\u2019s order was a correct application of the law to the facts presented.\u201d<\/span><\/p>\n<p><span style=\"font-size: 19px;\">He requested the court to delay the effect of the Magistrate\u2019s order until September 25, 2023, to fully consider the order\u2019s scope and its application of the law to the facts presented.<\/span><\/p>\n<p><span style=\"font-size: 19px;\">In the motion filed by his lawyer, Mr Carmichael, Tinubu emphasised that other courts, considering the authority of Magistrate to rule on Section 1782 applications opted for issuing reports and recommendations.<\/span><\/p>\n<p><span style=\"font-size: 19px;\">\u201cIntervenor raises a substantial question about the Magistrate\u2019s authority to resolve the Section 1782 petition and order immediate compliance by Chicago State University.<\/span><\/p>\n<p><span style=\"font-size: 19px;\">\u201c\u2018If Chicago State University complies with the Magistrate\u2019s order prior to this Court having an opportunity to review the order, Intervenor will suffer prejudice because the information will have been disclosed and effective relief will be impossible.<\/span><\/p>\n<p><span style=\"font-size: 19px;\">\u201cThe order requires the documents to be produced today. (Dkt. 40, pg. 31.)<\/span><\/p>\n<p><span style=\"font-size: 19px;\">\u201cBy contrast,\u00a0 Tinubu maintained that he has at least until September 27 to submit material, if not longer, and, as the Magistrate commented, the \u201ctight timeframe\u201d was created \u201cin no small part\u201d by applicant. (Dt. 40, pg. 28.)<\/span><\/p>\n<p><span style=\"font-size: 19px;\">\u201cThat leaves enough time for the Court to review the ruling and, if discovery were permitted to proceed, for the applicant to still obtain the information sought.<\/span><\/p>\n<p><span style=\"font-size: 19px;\">\u201cDue to the timing for compliance by Chicago State University \u2014 later today ~ Intervenor is filing this motion separately from its challenge to the Magistrate\u2019s ruling on the application. Intervenor intends to file, by the end of the day, a substantive brief addressing the errors in the magistrate\u2019s decision.<\/span><\/p>\n<p><span style=\"font-size: 19px;\">\u201cIntervenor requests that the Court defer compliance by Chicago State University until Monday, which will provide both an opportunity to review the Magistrate\u2019s ruling, and, if ordered, to allow the discovery to proceed before September 27.<\/span><\/p>\n<p><span style=\"font-size: 19px;\">\u201cFor example, a production could accur on Tuesday morning, be followed by a deposition in the afternoon, and a court reporter can provide a rough or real time transcript that evening.<\/span><\/p>\n<p><span style=\"font-size: 19px;\">\u201cCounsel for intervenor, Christopher W. Carmichael, communicated with counsel for applicant, Alexandre de Gramont, who opposes the motion.<\/span><\/p>\n<p><span style=\"font-size: 19px;\">\u201cWherefore, intervenor prays that the court grant the emergency motion and delay compliance with the magistrate\u2019s September 19, 2023 order until the end of the day Monday, September 25, 2023\u201d, the documents read.<\/span><\/p>\n<p><span style=\"font-size: 19px;\">Tinubu\u2019s motion was seen by the Special Adviser on Media and Publicity to the former Vice President, Mr. Paul Ibe, who confirmed its receipt.<\/span><\/p>\n<p><span style=\"font-size: 19px;\">Ibe, however, viewed Tinubu\u2019s motion as a delay tactic to slow down the release of academic records before the Supreme Court begins hearing Atiku\u2019s appeal against the September 6 judgement of the President Election Petition Tribunal.<\/span><\/p>\n<p><span style=\"font-size: 19px;\">\u201cNigerians will soon see the true position of Atiku on the academic qualifications of Tinubu.
