{"id":66597,"date":"2023-09-19T16:16:57","date_gmt":"2023-09-19T16:16:57","guid":{"rendered":"https:\/\/everyday.ng\/?p=66597"},"modified":"2023-09-19T16:16:57","modified_gmt":"2023-09-19T16:16:57","slug":"husband-of-ex-appeal-court-president-sen-bulkachuwa-loses-bid-to-stop-icpc-dss-investigation","status":"publish","type":"post","link":"https:\/\/everyday.ng\/?p=66597","title":{"rendered":"Husband of ex-Appeal Court President, Sen Bulkachuwa, loses bid to stop ICPC, DSS investigation"},"content":{"rendered":"<p><span style=\"font-size: 19px;\">By <strong>Yemi Oyeyemi<\/strong>\u00a0 Abuja.<\/span><\/p>\n<p><span style=\"font-size: 19px;\">A Federal High Court in Abuja, on Tuesday, dismissed the suit filed by Senator Adamu Bulkachuwa seeking to stop the Independent Corrupt Practices and Other Related Offences Commission (ICPC) from investigating him over the indicting comment he made during the valedictory session of the 9th National Assembly (NASS).<\/span><\/p>\n<p><span style=\"font-size: 19px;\">Justice Inyang Eden Ekwo, in a judgment, held that the suit lacked merit\u00a0 and outrightly dismissed it.<\/span><\/p>\n<p><span style=\"font-size: 19px;\">The judge said that Bulkachuwa, being a lawmaker, ought to understand the implications of the statement he made on the floor of the Senate.<\/span><\/p>\n<p><span style=\"font-size: 19px;\">According to him, the legislative immunity the plaintiff (Bulkachuwa) claims in this case does not avail him.<\/span><\/p>\n<p><span style=\"font-size: 19px;\">\u201cIt is the duty of every law-abiding citizen to assist and cooperate with law enforcement agencies in their quest to carry out their statutory function.<\/span><\/p>\n<p><span style=\"font-size: 19px;\">\u201cIt is only where a law enforcement agency breaches the fundamental right of a citizen in the process of carrying out their statutory function, then a cause of action could be said to have arisen,\u201d the judge said.<\/span><\/p>\n<p><span style=\"font-size: 19px;\">Bulkachuwa had sued the Attorney-General of the Federation (AGF), the NASS clerk, the State Security Service, ICPC and the Nigeria Police Force as 1st to 5th defendants, respectively.<\/span><\/p>\n<p><span style=\"font-size: 19px;\">He asked the court to declare that he \u201cis covered, privileged and protected by the parliamentary immunity as enshrined in Section 1 of the Legislative Houses (Powers and Privileges) Act 2017 and freedom of speech and expression made thereto is privileged.\u201d<\/span><\/p>\n<p><span style=\"font-size: 19px;\">The Bauchi Senator also prayed the court to declare that without exhausting the internal disciplinary mechanism, recommendations and approval of the 9th Senate, no other law enforcement agent of the Federal Government, including the defendants, can invite any member of the Senate for questioning\/interview.<\/span><\/p>\n<p><span style=\"font-size: 19px;\">However, Justice Ekwo held that the utterance made by Bulkachuwa on the floor of the Senate on June 10 was not covered by Section 39(1) of the 1999 Constitution.<\/span><\/p>\n<p><span style=\"font-size: 19px;\">&#8220;The provision is that every person shall be entitled to freedom of expression, including freedom to hold opinions and to receive and impart ideas and information without interference,&#8221; he said.<\/span><\/p>\n<p><span style=\"font-size: 19px;\">According to the judge, the clear words of Section 39 (1) of the 1999 Constitution (as amended) cannot be interpreted to mean that a person can say anything he likes.<\/span><\/p>\n<p><span style=\"font-size: 19px;\">\u201cIn a formal setting like that plenary session or committee proceedings of the Senate, It is not expected of a person who is privileged to voice any expression will utter words or express opinion or impart Ideas or gives\u2019 Information that cannot be defended under the constitution.<\/span><\/p>\n<p><span style=\"font-size: 19px;\">\u201cUpon studying the provision of Section 39 (1) of the 1999 Constitution (as amended), it is my opinion, that the words uttered by the plaintiff on the floor of the Senate on Saturday, 10th June, 2023 was a confession of doing an act that is prohibited by law.<\/span><\/p>\n<p><span style=\"font-size: 19px;\">\u201cWhen a person confesses that he influenced a judicial officer to help his friends and colleagues, such a person has gone beyond the limit of freedom of speech that is reasonably covered and protected by the provision of Section 39 (1) of the 1999 Constitution (as amended).<\/span><\/p>\n<p><span style=\"font-size: 19px;\">\u201cA person who has used the opportunity given to him by the constitution to express himself freely and uses the opportunity to expose his actions or conduct which the law of the land criminalises, he has unwittingly invited law enforcement agencies to question him.<\/span><\/p>\n<p><span style=\"font-size: 19px;\">\u201cThis is what the plaintiff did in this case.<\/span><\/p>\n<p><span style=\"font-size: 19px;\">\u201cI therefore find that that the speech of the plaintiff on the floor of the Senate on June 10, was a confession of an illegal act and Section 39 (1) of the 1999 Constitution (as amended) cannot be invoked to cover such and I so hold,\u201d the judge said.<\/span><\/p>\n<p><span style=\"font-size: 19px;\">In a viral video clip on June 12, 2023, Senator Bukachuwa said his wife, President of the Court of Appeal, Justice Zainab Bulkachuwa, assisted his colleagues at the National Assembly as a serving judge.<\/span><\/p>\n<p><span style=\"font-size: 19px;\">He had said, \u201cI look at faces in this chamber who have come to me and sought for my help when my wife was the President of the Court of Appeal.<\/span><\/p>\n<p><span style=\"font-size: 19px;\">\u201cAnd I must thank particularly my wife, whose freedom and independence I encroached upon while she was in office, and she has been very tolerant and accepted my encroachment and extended her help to my colleagues.<\/span><\/p>\n<p><span style=\"font-size: 19px;\">\u201cI did my best and in most cases I succeeded,\u201d Senator Bulkachuwa had said, while the then Senate President, Ahmed Lawan, interjected and quickly stopped him from going further in the public confession.<\/span><!--\/data\/user\/0\/com.samsung.android.app.notes\/files\/clipdata\/clipdata_bodytext_230919_171253_603.sdocx--><\/p>\n","protected":false},"excerpt":{"rendered":"<p>By Yemi Oyeyemi\u00a0 Abuja.
