{"id":6563,"date":"2017-12-19T19:44:39","date_gmt":"2017-12-19T19:44:39","guid":{"rendered":"https:\/\/everyday.ng\/?p=6563"},"modified":"2017-12-19T19:44:39","modified_gmt":"2017-12-19T19:44:39","slug":"ekiti-student-becomes-millionaire-reinstated-four-years-after-expulsion","status":"publish","type":"post","link":"https:\/\/everyday.ng\/?p=6563","title":{"rendered":"Ekiti Student becomes millionaire, reinstated four years after expulsion"},"content":{"rendered":"<p>From <strong>Jimoh Joseph<\/strong>, Ado-Ekiti<br \/>\nFour years after he was expelled for alleged involvement in rape, a<br \/>\nstudent of Ekiti State University (EKSU), Adedotun Babalola, has won a legal battle for his reinstatement.<br \/>\nAn Ekiti State High Court has ordered EKSU to reinstate Babalola and<br \/>\nawarded N10 million damages against the university.<br \/>\nThe judgment was consequent upon a case of breach of fundamental human<br \/>\nrights filed by the plaintiff who averred before the court that he was<br \/>\nexpelled from the university without being found guilty by any court<br \/>\nor tribunal.<br \/>\nJoined as Respondents in the suit are EKSU, Vice Chancellor, the<br \/>\nSenate, the Registrar and the Council.<br \/>\nJustice John Adeyeye who granted all the reliefs sought by the<br \/>\nplaintiff held that Babalola\u2019s expulsion by EKSU management<br \/>\nconstituted a breach of fundamental human rights to fair hearing.<br \/>\nAdeyeye ruled that EKSU was wrong to have terminated the studentship<br \/>\nof the plaintiff without trial ordering the university to allow him to<br \/>\ncontinue his studies without further delay.<br \/>\nApart from the order to pay the plaintiff N10 million aggravated<br \/>\ndamages, the judge also ordered the university to write a letter of<br \/>\nunreserved apology to be published in three national newspapers.<br \/>\nBabalola and Omoteye Olalekan were earlier arraigned before another<br \/>\ncourt presided over by Justice Ayodeji Daramola for an alleged offence<br \/>\nof having unlawful carnal knowledge of one Bosede Olabanji on 6th<br \/>\nMarch, 2013.<br \/>\nCounsel to the plaintiff, Mr. Magnus Ejelonu, hailed the court for<br \/>\nredressing the wrong done to Babalola.<br \/>\nCounsel to EKSU, Mr. Ajide Olayemi, said he would consult with the<br \/>\nmanagement to know the next line of action.<br \/>\nBut Justice Daramola struck out the case \u201cin the interest of justice\u201d<br \/>\nbecause of its shoddy handling by the prosecution and the non-interest<br \/>\nof the victim of the alleged offence of rape in the case.<br \/>\nThe plaintiff filed a suit for the enforcement of his fundamental<br \/>\nhuman rights following the refusal of the university to reabsorb him<br \/>\nafter the case of rape against him was struck out.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>From Jimoh Joseph, Ado-Ekiti Four years after he was expelled for alleged involvement in rape, a student of Ekiti State University (EKSU), Adedotun Babalola, has won a legal battle for his reinstatement.
