Justice Ahmed Mohammed of the Federal High Court sitting in Abuja, has ordered the arrest of British national, James Nolan for jumping bail and failing to appear for\u00a0 trial.<\/p>\n
Nolan, a Director in the Process and Industrial Development Limited, P&ID, is standing trial, \u00a0alongside Lurgi Consult Limited and others, \u00a0in \u00a0a money laundering case to the tune of $9.6 billion.<\/p>\n
Delivering a ruling on Wednesday, September 28, 2022, Justice Mohammed\u00a0stated that Nolan has broken the terms of his bail conditions offered him by the court \u00a0and therefore revoked the bail and issued a bench warrant \u00a0for his arrest.<\/p>\n
He also ordered his\u00a0 surety \u00a0to appear in court on the next adjourned date,\u00a0 to justify why the \u00a0bail bond \u00a0should not be \u00a0forfeited to the court.<\/p>\n
Prosecution counsel, Bala Sanga, had earlier prepared \u00a0to proceed with \u00a0the cross examination of Prosecuting Witness 1, Temitope Erinomo, \u00a0\u00a0when the court was informed that the second defendant was nowhere to be found and efforts to ascertain his whereabouts \u00a0proved abortive.<\/p>\n
Sanga expressed dismay with the absence of Nolan\u00a0 in court,\u00a0\u00a0\u00a0 saying that the first defendant, Lurgi Consult Limited, has never been represented in court, \u00a0as a corporate body, \u00a0since the matter started.<\/p>\n
He also told the court that investigations by the EFCC showed that \u00a0the property given by the surety, in \u00a0Gwagwalada, Abuja,\u00a0 was not worth N100m.\u00a0 He prayed the court to restrain the defence team from further delaying the case.<\/p>\n
Responding to the absence of Nolan in court, defence counsel, Micheal Ajara claimed that his sudden disappearance was strange.<\/p>\n
\u201c My \u00a0Lord, the defendant in question, \u00a0has always appeared in court, \u00a0except for the last adjourned date that he was sick. His medical report shows that he has bipolar, a history of mental illness and it is uncertain if the defendant is fine. We have notified the police, including the prosecution, and all efforts to ascertain his whereabouts \u00a0has proven abortive\u201d, he said.<\/p>\n
He prayed the court to grant the defence time to ascertain his whereabouts\u201d.<\/p>\n
Justice Mohammed says that the court of law does not act in uncertainty except Ajara presents facts. \u00a0\u201cWhat is clear to the court right now, \u00a0is that the second defendant is nowhere to be found and there is no justification with certainty of his whereabouts\u201d, he said.<\/p>\n
