{"id":58816,"date":"2022-07-15T18:02:45","date_gmt":"2022-07-15T18:02:45","guid":{"rendered":"https:\/\/everyday.ng\/?p=58816"},"modified":"2022-07-15T18:02:45","modified_gmt":"2022-07-15T18:02:45","slug":"after-baba-ijesha-father-gets-life-imprisonment-for-raping-three-daughters","status":"publish","type":"post","link":"https:\/\/everyday.ng\/?p=58816","title":{"rendered":"After Baba Ijesha, father gets life imprisonment for raping three daughters"},"content":{"rendered":"<p>A middle aged man, Michake Ogbar,who defiled and raped his three daughters:aged 10 years, 20 years and 24 years, has bagged three life imprisonments from an Ikeja Domestic Violence and Sexual Offences Court.<\/p>\n<p>Justice Abiola Soladoye said \u201cthe evidence before the court shows that the prosecution has proved the case of defilement and rape brought before this court\u201d.<\/p>\n<p>\u201cThe defendant, who is the father of the three daughters, is found guilty as charged, as the burden of proof has been discharged. This is a very sad case,\u201d she said.<\/p>\n<p>The judge said it was disheartening that\u00a0 the man raped his daughters for years in the absence of his wife, adding that the development \u201cis a disgrace to parenthood\u201d.<\/p>\n<p>She said: \u201cThe defendant ravished his own daughters in turn, committing incest. It is rather shameful and most perverted.<\/p>\n<p>\u201cThe defendant is hereby found guilty and sentenced to life imprisonment on count one.<\/p>\n<p>\u201cOn count two, he is sentenced to life imprisonment and on count three, he is also sentenced to life imprisonment.\u201d<\/p>\n<p>The sentences would run concurrently, the Judge said, adding that the convict&#8217;s name should be put in the Lagos State Sexual Offenders Register..<\/p>\n<p>Recall that an Ikeja Special Offences Court on Thursday sentenced \u00a0the embattled Nollywood actor, Olanrewaju James, alias Baba Ijesha, to five years imprisonment for sexually assaulting a 14-year-old girl.<\/p>\n<p>Delivering judgment, Justice Oluwatoyin Taiwo, \u00a0held that the prosecution had successfully proven the charge of sexual assault of a minor and indecent treatment of a minor against the convict.<\/p>\n<p>The judge, however, discharged and acquitted him of\u00a0count one and six which were sexual assault by penetration (which \u00a0took place in \u00a02014) and attempted sexual assault by penetration, which took place in 2021).<\/p>\n<p>She further held that \u00a0the medical report was inconclusive as the medical examiner \u00a0could not \u00a0show if the lacerations \u00a0that occurred \u00a0was the one of seven years ago or a recent one.<\/p>\n<p>\u201cThe question here is that penetration occurred \u00a0seven years prior to the one that happened in 2021 \u00a0but we do not know by whom or the time it occurred.<\/p>\n<p>\u201cThe survivor never reported that particular incident to her mother at that time and therefore \u00a0any injury on the vagina could have vanished \u00a0seven years ago.<\/p>\n<p>\u201cThe survivor herself told the court that she was easily distracted by boys and one uncle Damola assaulted her.<\/p>\n<p>Taiwo held that the confessional statement of the convict that he romanced the survivor seven years after the first incident by licking her fingers and arousing her but denied inserting keys in her private part.<\/p>\n<p>\u201cThe defendant confessed \u00a0that he molested the girl in 2021.<\/p>\n<p>\u201cThe court \u00a0can convict a person based on his confessions. The defendant was consistent in his admission in the two videos.<\/p>\n<p>\u201cThe pain of the first prosecution witness (Princess) was real. The girl was scared and we could see the fears I her eyes while she was giving her evidence before the court. She was compelled to make her evidence.<\/p>\n<p>\u201cThe argument of the defence that the prosecution failed to state the exact age of the survivor can not \u00a0stand as the law states that anyone under the \u00a0age of \u00a018 \u00a0years \u00a0is regarded as a child.<\/p>\n<p>\u201cThe defendant may not have the thought of having \u00a0sex with the survivor on that day \u00a0but he aroused her by sucking her fingers and rubbing her body. He did not take off his clothes while arousing her.<\/p>\n<p>\u201cI hereby find the defendant guilty of count two to five and he is discharged of counts one and six.<\/p>\n<p>\u201cThe defendant is here by sentenced to \u00a0five years imprisonment for count two, \u00a0three years for count three, \u00a0five years for count four and three years for \u00a0count five.<\/p>\n<p>\u201d The sentencing should run concurrently because of the allocutus and must take effect from today, July 14, \u201d the judge held.<\/p>\n<p>The News Agency of Nigeria (NAN) reports that the defence counsel, Mr Gabriel Olabiran, in his allocutus, prayed the court to consider the least sentence to the convict so as not to be deserted by his colleagues<\/p>\n<p>Olabiran said that the convict was a first offender who had passed through trauma of incarceration both at Panti \u00a0and in Kirikiri Correctional Centre.<\/p>\n<p>\u201cThere is no doubt that the defendant is very remorseful. My lord, we pray you consider th fact that the defendant is an actor who has impacted positively to the society in the course of his career.<\/p>\n<p>\u201cWe urge your lordship \u00a0to be lenient with the defendant who has lost almost all his image all over the world ND will be deserted by his colleagues in the movie industry.<\/p>\n<p>\u201cHe has an aged parents, wife and son who depend on him and they look up to him coming back home. We assure the court that the defendant is a changed \u00a0person \u00a0who will not go back to his vomit.<\/p>\n<p>\u201cWe urge the court to be merciful \u00a0unto \u00a0him \u00a0and consider the least sentence,\u201d Olabiran said.<\/p>\n<p>The prosecution team led by the Director of the Department of Public Prosecution (DPP), Dr Babajide Martins, however, left the sentencing at the discretion of the court.<\/p>\n<p>\u201cThe law has taken his course. The offences that my lord has found the defendant liable have custodial sentencing.<\/p>\n<p>\u201cCount \u00a0two is for seven years, \u00a0count three is for \u00a0four years, count four is liable for \u00a0seven years and count five is for \u00a0three years.<\/p>\n<p>\u201cWe, however, leave the sentencing at the discretion of the court.,\u201d Martin said.<\/p>\n<p>NAN reports that Baba Ijesha was arraigned before Taiwo on June 24, 2019 on six counts of indecent treatment of a child, sexual assault, attempted sexual assault by penetration and sexual assault by penetration.<\/p>\n<p>According to the prosecution team, \u00a0Baba Ijesha sexually assaulted the 14-year-old foster daughter of actress and comedienne, Ms Damilola Adekoya, Alias Princess, in her residence.<\/p>\n<p>The prosecution presented six witnesses to testify against Baba Ijesha during the trial.<\/p>\n<p>The witnesses are actress and comedienne, Princess, the 14-year-old minor, a child expert, Mrs Olabisi Ajayi-Kayode, and medical doctor, Dr Aniekan Makanjuola.<\/p>\n<p>Others were the Investigating Police Officer, ASP Wahab Kareem and a policewoman, Insp. Abigail Omane.<\/p>\n<p>The DPP closed its case against the defendant on Dec. 15, 2021 while Baba Ijesha called four witnesses and closed its defence on April 1.<\/p>\n<p>The defence witnesses were Baba Ijesha\u00a0 (defendant) and Mr Lawrence Ayeni, an expert in video production and CCTV installation and maintenance.<\/p>\n<p>Mr Olukayode Olugbemi, a clinical psychologist and Mr Olukayode Ogunbanjo, the defendant\u2019s friend and colleague also testified for the defence.<\/p>\n<p>The offence, the prosecution said, contravened the provisions of sections 135, 259, 261, 262 and 263 of the Criminal Laws of Lagos State 2015<\/p>\n<p style=\"text-align: center;\">\u25aa\ufe0e Reports by <strong>NAN<\/strong><\/p>\n","protected":false},"excerpt":{"rendered":"<p>A middle aged man, Michake Ogbar,who defiled and raped his three daughters:aged 10 years, 20 years and 24 years, has bagged three life imprisonments from an Ikeja Domestic Violence and Sexual Offences Court.
