{"id":5829,"date":"2017-11-13T12:33:33","date_gmt":"2017-11-13T12:33:33","guid":{"rendered":"https:\/\/everyday.ng\/?p=5829"},"modified":"2017-11-13T12:33:33","modified_gmt":"2017-11-13T12:33:33","slug":"ndumes-troubles-worsen-senate-appeals-judgment-recalling-him","status":"publish","type":"post","link":"https:\/\/everyday.ng\/?p=5829","title":{"rendered":"Ndume&#8217;s troubles worsen; Senate appeals judgment recalling him"},"content":{"rendered":"<p>The political nightmares of suspended but recalled Senator Ali Ndume representing Borno South Senatorial District took a new dimension Monday as the Upper Legislative House has opted to appeal a court order that recalled him.<br \/>\nNdume has been away from the Senate for six months after members sent him home for going against them over issues related to the non-confirmation of  Economic and Financial Crimes Commission boss, Ibrahim Magu.<br \/>\nNdume was, again, recently dragged to the National Assembly by State Borno lawmakers for allegedly assaulting one of them.<br \/>\nYesterday, the legal counsel to the Senate, Mike Ozekhome SAN, issued a statement on the Senate&#8217;s intention. It reads: Senate of the Federal Republic of Nigeria, will on Monday,\u00a0November 13, 2017, file an appeal against the judgment of the Federal High Court,\u00a0delivered\u00a0today,\u00a010th\u00a0of November, 2017,\u00a0.<br \/>\nIt is important to\u00a0state\u00a0clearly,\u00a0that\u00a0the Senate\u00a0respectfully\u00a0disagrees\u00a0with the\u00a0said\u00a0judgment.<br \/>\nFor the\u00a0records, the\u00a0Senate\u00a0had\u00a0challenged the jurisdiction of the\u00a0Federal High\u00a0Court\u00a0toentertain the matter on several grounds,\u00a0portions\u00a0of which\u00a0are\u00a0outlined\u00a0hereunder for the purpose\u00a0of emphasis, as follows:\u00a0<br \/>\n1.\u00a0That the\u00a0Plaintiff\u00a0wrongly\u00a0joined\u00a0several causes of action in his Originating Summons.<br \/>\n2.\u00a0That an action for the enforcement of fundamental rights to fair hearing can only be brought against a court or a tribunal,\u00a0established by law\u00a0as held by the Supreme Court in several current cases, and not against Committee of a legislative body.<br \/>\n3.\u00a0That by the provisions of\u00a0sections 3 and 30 of the Legislative Houses (Powers and Privileges) Act, the trial court lacked requisite jurisdiction to hear the suit of the Plaintiff.<br \/>\nThe Senate\u2019s\u00a0argument was supported by various and current decisions of the apex court.\u00a0The Senate of the Federal Republic of\u00a0Nigeria\u00a0which\u00a0has\u00a0the strong conviction that the decision of the trial court will be overturned by the Court of Appeal,\u00a0  has\u00a0accordingly instructed the law firm of Mike Ozekhome\u2019s Chambers,\u00a0to file an appeal against the judgment\u00a0immediately.<br \/>\nThe\u00a0notice of appeal is ready and would be filed unfailingly by Monday morning.\u00a0An application\u00a0for\u00a0a stay of execution of the orders of the court\u00a0will also be filed same time.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>The political nightmares of suspended but recalled Senator Ali Ndume representing Borno South Senatorial District took a new dimension Monday as the Upper Legislative House has opted to appeal a court order that recalled him.
