{"id":35846,"date":"2021-09-28T17:14:53","date_gmt":"2021-09-28T16:14:53","guid":{"rendered":"https:\/\/everyday.ng\/?p=35846"},"modified":"2021-09-28T17:14:53","modified_gmt":"2021-09-28T16:14:53","slug":"alleged-n400-million-fraud-court-okays-retrial-of-ex-pdp-spokesman-olisa-metuh-oct-14","status":"publish","type":"post","link":"https:\/\/everyday.ng\/?p=35846","title":{"rendered":"Alleged N400 Million Fraud: Court Okays Retrial Of Ex-PDP Spokesman, Olisa Metuh Oct. 14"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\">The Federal High Court, Abuja on Tuesday, fixed Oct. 14 for the arraignment of former National Publicity Secretary of Peoples Democratic Party (PDP), Olisa Metuh, over an alleged N400 million fraud.<\/p>\n\n\n<p class=\"wp-block-paragraph\">The date was fixed following the absence of the new trial Judge, Obiora Egwuatu, in court.<\/p>\n\n\n<p class=\"wp-block-paragraph\">The News Agency of Nigeria (NAN) reports that all the parties in the matter, including Mr Metuh, were in court.<\/p>\n\n\n<p class=\"wp-block-paragraph\">But Metuh\u2019s retrial could not proceed because of the judge\u2019s absence.<\/p>\n\n\n<p class=\"wp-block-paragraph\">NAN reports that the Court of Appeal, Abuja on Dec. 16, 2020, nullified a Federal High Court judgement that convicted and sentenced Metuh to seven years imprisonment for money laundering.<\/p>\n\n\n<p class=\"wp-block-paragraph\">In a unanimous decision, a three-man panel of Justices of the appellate court, held that the judgment of the trial Judge, Okon Abang, delivered against Metuh on Feb. 25, 2020, was tainted with bias.<\/p>\n\n\n<p class=\"wp-block-paragraph\">The appellate court held that Abang, had by disparaging remarks he made in the judgement, betrayed his premeditated mindset against the defendant (Metuh) whom he accused of writing various petitions against him.<\/p>\n\n\n<p class=\"wp-block-paragraph\">According to Justice Stephen Adah who delivered the lead verdict of the appellate court, allowing the trial court\u2019s verdict to stand \u201cwill set a dangerous precedent.\u201d<\/p>\n\n\n<p class=\"wp-block-paragraph\">Consequently, it voided the conviction and sentence that was handed to Metuh and his firm, Destra Investment Limited, and remitted the case file back to the high court for a re-trial by another judge.<\/p>\n\n\n<p class=\"wp-block-paragraph\">Although Metuh\u2019s matter was on number six in the Tuesday\u2019s case list, the retrial could not commence.<\/p>\n\n\n<p class=\"wp-block-paragraph\">NAN reports that Metuh was jailed over the allegation that he received the sum of N400 million from the former National Security Adviser, rtd Col.
