{"id":26543,"date":"2020-06-02T15:04:09","date_gmt":"2020-06-02T14:04:09","guid":{"rendered":"https:\/\/everyday.ng\/?p=26543"},"modified":"2020-06-02T15:04:09","modified_gmt":"2020-06-02T14:04:09","slug":"plot-to-stop-dongban-mensem-as-appeal-court-president-thickens","status":"publish","type":"post","link":"https:\/\/everyday.ng\/?p=26543","title":{"rendered":"Plot to stop Dongban-Mensem as appeal court president thickens"},"content":{"rendered":"<p dir=\"ltr\"><b>There is a grand plan to stop\u00a0Monica Bolna\u2019an Dongban-Mensem from being appointed the substantive president of the court of appeal (PCA), TheCable can report.<\/b><\/p>\n<p dir=\"ltr\">Rather, there is a push for Mohammed Lawal Garba, who chaired the 2019 presidential election petitions tribunal, to be appointed in her place.<\/p>\n<p dir=\"ltr\">Although tongues are wagging that it is because\u00a0Dongban-Mensem is a minority northern Christian and Garba is a northern Muslim, TheCable understands that the intrigues are more political than ethnic or religious.<\/p>\n<p dir=\"ltr\">The Federal Judicial Service Commission (FJSC) had recommended both\u00a0Dongban-Mensem and Lawal \u2014 in that order \u2014 to the National Judicial Commission (NJC) to replace\u00a0Zainab Bulkachuwa, who retired in March 2020 having clocked 70.<\/p>\n<p dir=\"ltr\">Dongban-Mensem, from Plateau state, is the most senior judge in the federal court of appeal.<\/p>\n<p dir=\"ltr\">The NJC forwarded\u00a0Dongban-Mensem\u2019s name to President Muhammadu Buhari for onward transmission to the senate for confirmation.<\/p>\n<p dir=\"ltr\">However, Buhari is yet to send her name for confirmation nearly three months later.<\/p>\n<p dir=\"ltr\">Instead, he appointed her in a protem position and recently renewed it for another three months, which could see her act as PCA till September 2020<\/p>\n<p dir=\"ltr\">TheCable understands that dirt-digging is now being employed by presidential advisers to get\u00a0Dongban-Mensem disqualified and pave the way for Garba.<\/p>\n<p dir=\"ltr\">Her national youth service record is being scrutinised, but TheCable learnt that she did serve in 1980\/81.<\/p>\n<p dir=\"ltr\">More so, according to government insiders, it would be \u201cmysterious\u201d to question the credentials of someone who has been screened by both the\u00a0FJSC \u2014 of which Abubakar Malami, the attorney-general of the federation and minister of justice, is a member \u2014 and the NJC.<\/p>\n<p dir=\"ltr\">Garba, the preferred candidate, chaired the presidential election petitions tribunal which\u00a0<b><a href=\"http:\/\/www.thecable.ng\/breaking-buhari-qualified-to-contest-presidential-election-tribunal-rules\">ruled in favour of Buhari<\/a><\/b>\u00a0in September 2019.<\/p>\n<p dir=\"ltr\"><b><a href=\"http:\/\/www.thecable.ng\/lagos-appeal-court-judge-replaces-bulkachuwa-on-presidential-tribunal\">Garba had replaced\u00a0Bulkachuwa<\/a><\/b>\u00a0as chairman of the tribunal following protest by the opposition Peoples Democratic Party (PDP) over an alleged conflict of interest.<\/p>\n<p dir=\"ltr\">Bulkachuwa\u2019s husband is a senator on the platform of the All Progressives Congress (APC) \u2014 the president\u2019s party.<\/p>\n<p dir=\"ltr\">Buhari\u2019s media team did not respond to questions from TheCable on why\u00a0Dongban-Mensem\u2019s name has not been sent to the senate for confirmation.<\/p>\n<p dir=\"ltr\"><b>UMAR WEIGHS IN<\/b><\/p>\n<p dir=\"ltr\">On Sunday, Abubakar Umar Dangiwa, a retired colonel and former military governor of Kaduna state,\u00a0<b><a href=\"http:\/\/www.thecable.ng\/breaking-your-lopsided-appointments-will-ruin-nigeria-umar-dangiwa-hits-buhari\">warned Buhari<\/a><\/b>\u00a0that his \u201clopsided appointments will ruin Nigeria\u201d.<\/p>\n<p dir=\"ltr\">In the widely circulated letter, he wrote: \u201cMay I also invite the attention of Mr. President to the pending matter of appointment of a Chief Judge of the Nigerian Court Appeal which appears to be generating public interest. As it is, the most senior Judge, Justice Monica Dongban Mensem, a northern Christian, is serving out her second three-month term as acting Chief Judge without firm prospects that she will be confirmed substantive head.<\/p>\n<p dir=\"ltr\">\u201cI do not know Justice Mensem but those who do attest to her competence, honesty and humility. She appears eminently qualified for appointment as the substantive Chief Judge of the Court of Appeal as she is also said to be highly recommended by the National Judicial Council. If she is not and is bypassed in favor of the next in line who happens to be another northern Muslim, that would be truly odd.<\/p>\n<p dir=\"ltr\">\u201cIn which case, even the largest contingent of PR gurus would struggle to rebut the charges that you, Mr. President, is either unwilling or incapable of acting on your pledge to belong to everyone \u2014 and to no one. I hope you would see your way into pausing and reflecting on the very grave consequences of such failure not just to your legacy but to the future of our great country.\u201d<\/p>\n<p dir=\"ltr\"><b>WHO IS\u00a0DONGBAN-MENSEM?<\/b><\/p>\n<div align=\"left\">\n<p dir=\"ltr\">-Born on June 13, 1957, to the family of M.B.
