{"id":26531,"date":"2020-05-31T17:35:25","date_gmt":"2020-05-31T16:35:25","guid":{"rendered":"https:\/\/everyday.ng\/?p=26531"},"modified":"2020-05-31T17:35:25","modified_gmt":"2020-05-31T16:35:25","slug":"maryam-sanda-killed-her-husband-she-should-die-police-insists","status":"publish","type":"post","link":"https:\/\/everyday.ng\/?p=26531","title":{"rendered":"Maryam Sanda Killed Her Husband, She Should Die, Police Insists"},"content":{"rendered":"<p>By <strong>Yemi Oyeyemi,<\/strong> Abuja<br \/>\n&#8230; Asks Appeal Court To Affirm Her Death Sentence<br \/>\nThe Police has prayed the Court of Appeal, Abuja Division to uphold the death sentence imposed on Maryam Sanda by an Abuja High Court for killing her husband, Bilyaminu Bello.<br \/>\nIn its brief of argument filed in response to the appeal filed by Sanda&#8217;s legal team led by Joe Kyari Gadzama (SAN), the police submitted that the trial court was right in finding Sanda guilty of willfully murdering her husband in cold blood.<br \/>\nAccording to Police Counsel, James Idachaba, the trial judge, Justice Yusuf Halilu properly evaluated the evidence before him in reaching the decision to find Sanda guilty and impose the punishment as provided by statute.<br \/>\nHe argued that to set aside the decision of the trial court would amount to giving an incentive to angry and unhappy spouses to take the life of their partner at will.<br \/>\nIdachaba said the law was meant to serve as a deterrent to others who wish to commit the crime of culpable homicide, adding that a reversal of the judgment of the trial court would surely defeat the purpose of the law.<br \/>\nHe said Sanda was guilty of taking her husband&#8217;s life and therefore deserving of the death penalty imposed on her.<br \/>\nThe Police counsel described Sanda&#8217;s appeal as baseless, frivolous and lacking in merit, praying the Court of Appeal to dismiss it with cost.<br \/>\nJustice Halilu had on January 27, 2020 found Sanda guilty of stabbing her husband with a kitchen knife with clear intent to kill.<br \/>\nThe judge said he reached his verdict by relying on the compelling circumstantial evidence and testimonies of the six witnesses called by the police, the relatives of the convict who cleaned up the scene of the murder; a post-mortem examination on the deceased\u2019s corpse; and the contradictory statements of the convict.<br \/>\nThe judge said he also relied on the \u201cDoctrine of the Last Scene\u201d, which stipulates that the last person at a crime scene bears full responsibility.<br \/>\n\u201cIt serves to buttress the finding that the defendant was the last to be seen with the deceased and therefore has full responsibility of what caused his death\u201d, Mr Halilu noted.<br \/>\nBut in an appeal filed by Sanda&#8217;s lawyers, he contended that the judgment was flawed as the charge of murder was not proven beyond reasonable doubt.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>By Yemi Oyeyemi, Abuja &#8230; Asks Appeal Court To Affirm Her Death Sentence The Police has prayed the Court of Appeal, Abuja Division to uphold the death sentence imposed on Maryam Sanda by an Abuja High Court for killing her husband, Bilyaminu Bello.
