The Department of State Services (DSS) is saying no one has come to take politician and advocate of the #RevoltionNow campaign, Mr. Omoyele Sowore, from its custody since the agency got the court order for his release.
\nBut Human rights activist and Sowore’s lawyer, Mr. Femi Falana, told Nigeria Everyday<\/strong> on phone last night, he had also just seen the statement late last night and would send two lawyers to pick them in the morning
\n“I will send two lawyers to pick them up tomorrow morning, I have just seen their statement,” he said
\nA source said it was not a difficult thing for the DSS to deliver Sowore to the Office of Mr. Femi Falana, knowing he had been sending lawyers there to have him released.
\nHe also said it was not a difficult thing for Sowore to find his way from the DSS office, but reminded of the security implications of doing that at about 10.00 p.m., he said other arrangements would be made.
\nIn a statement, the spokesman for the secret police, Dr. Peter Afunanya confirmed that it has received the Court Order for the release of Omoyele SOWORE.
\nHe adds: “It is important that the public notes that since the receipt of the Order, no person has turned up at the DSS to take delivery of him. This becomes imperative for reasons of accountability.
\n“However, the Court has been properly briefed on this development and the steps being taken to ensure compliance with its Order.
\n“The Service, under the leadership of Yusuf Magaji Bichi (fwc), as the Director General, is not a lawless organization and will never obstruct justice or disobey Court Orders.
\n“It, therefore, affirms that it will do all that is needful once the appropriate processes have been concluded.”
\nRecall that online newspaper, Premium Times, had published that the detained political activist and publisher of Sahara Reporter online news platform, Sowore, had embarked on a hunger strike over the refusal of the State Security Service (SSS) to set him free after meeting his bail conditions.
\nThe paper states further:
\nIn a text message to PREMIUM TIMES on Friday, his lawyer, Femi Falana, said Mr Sowore has refused to eat or see anybody.
\nMr Sowore has been in detention since August 3 when he was arrested two days to the Revolution Now protest his group was organising in Nigeria.
\n\u201cSince yesterday (Thursday) he has refused to come down. He has refused to see anybody and this is in protest that his rights are being violated.
\n\u201cHe has not eaten because the DSS don\u2019t feed him and he is rejecting food from the people who usually take food to him in detention.\u201d
\nMr Falana explained that the detained activist insisted on not seeing anyone, including the people who take his food to him in prison \u201cbecause there is a court order asking for him to be released, the second one, so he is protesting this.\u201d
\nFalana Threatens to sue SSS
\nIn a related development, Mr Falana, a senior advocate of Nigeria (SAN), has threatened legal action against the SSS, for refusing to release Mr Sowore.
\nThe human rights activist was arrested and detained on allegations of a treasonable felony after he organised the nationwide protest with the hashtag #RevelutionNow.
\nHe was granted bail on October 4 for the second time after an initial one in September by another judge was not honoured by the SSS.
\nMr Sowore said the conditions for the October 4 bail were stringent and approached the court for a variation.
\nThough the court varied Mr Sowore\u2019s second bail on October 21, he could not immediately meet the new conditions. Mr Falana informed the court on Wednesday during Mr Sowore\u2019s trial that the activist had met his bail conditions.
\nThe judge later confirmed he had met the bail conditions and signed that Mr Sowore should be released.
\nHowever, in a statement on Thursday, Mr Falana said it was the second time the SSS would ignore a court order to release Mr Sowore.
\n\u201cOn 8th August 2019, the Honourable Justice Taiwo Taiwo granted the application of the State Security Service to detain Mr Omoyele Sowore for 45 days.
\n\u201cUpon the expiration of the 45-day detention period the court granted Mr Sowore bail on September 24, 2019. He met the bail conditions but the State Security Service refused to release him from custody.
\n\u201cMr Sowore and Mandate Bakare were subsequently charged with treasonable felony, cyberstalking and money laundering on September 30, 2019.\u201d
\nMr Falana in the statement said the court again granted the duo bail and that upon meeting the bail conditions the judge ordered the SSS to release them.
\n\u201cThe trial judge, the Honourable Justice Ijeoma Ojukwu, admitted the defendants to bail under very stringent conditions. Upon meeting the bail conditions, Justice Ojukwu directed the State Security Service to release the defendants from detention.
\n\u201cBut in utter contempt of the orders of Justice Ojukwu the State Security Service has refused to release Messrs Sowore and Bakare from custody.
\n\u201cSince the State Security Service is not above the law of the land we shall embark on appropriate legal measures to ensure compliance with the court orders,\u201d the lawyer said.
