{"id":13085,"date":"2018-10-30T17:34:26","date_gmt":"2018-10-30T17:34:26","guid":{"rendered":"https:\/\/everyday.ng\/?p=13085"},"modified":"2018-10-30T17:34:26","modified_gmt":"2018-10-30T17:34:26","slug":"n182-5m-award-lodge-amount-in-interest-yielding-account-before-appealing-judgment-court-tells-nasg","status":"publish","type":"post","link":"https:\/\/everyday.ng\/?p=13085","title":{"rendered":"N182.5M award: Lodge amount in interest yielding account before appealing judgment &#8211; Court tells NASG"},"content":{"rendered":"<div id=\"m-3846303475282004656\" class=\"mail-message expanded\">\n<div class=\"mail-message-header spacer\">From <strong>Ron Jacob,<\/strong> Jos<\/div>\n<div class=\"mail-message-content collapsible zoom-normal mail-show-images \">\n<div class=\"clear\">\n<div id=\"m_-9135333760898547329yui_3_16_0_ym19_1_1540909697502_3779\"><\/div>\n<div id=\"m_-9135333760898547329yui_3_16_0_ym19_1_1540909697502_3781\"><span id=\"m_-9135333760898547329yui_3_16_0_ym19_1_1540909697502_3782\" lang=\"EN-US\"><span id=\"m_-9135333760898547329yui_3_16_0_ym19_1_1540909697502_3783\" style=\"font-family: Times New Roman;\">The National Industrial Court (NIC) has ordered the Nassarawa State Government and the Nassarawa United FC to lodge N182.5 million awarded to coaches and players into an interest yielding account before appealing against its judgement.<\/span><u><\/u><u><\/u><\/span><\/div>\n<div id=\"m_-9135333760898547329yui_3_16_0_ym19_1_1540909697502_3785\"><\/div>\n<div id=\"m_-9135333760898547329yui_3_16_0_ym19_1_1540909697502_3787\"><span id=\"m_-9135333760898547329yui_3_16_0_ym19_1_1540909697502_3788\" lang=\"EN-US\"><span id=\"m_-9135333760898547329yui_3_16_0_ym19_1_1540909697502_3789\" style=\"font-family: Times New Roman;\">The amount (N182.544.00) is the total sum the state government owed five of its former coaches and 37 players, being their unpaid salaries and sign-on-fees, but which the court on April 16 ordered the government to pay on or before April 30, 2018.<\/span><u><\/u><u><\/u><\/span><\/div>\n<div id=\"m_-9135333760898547329yui_3_16_0_ym19_1_1540909697502_3791\"><\/div>\n<div id=\"m_-9135333760898547329yui_3_16_0_ym19_1_1540909697502_3793\"><span id=\"m_-9135333760898547329yui_3_16_0_ym19_1_1540909697502_3794\" lang=\"EN-US\"><span id=\"m_-9135333760898547329yui_3_16_0_ym19_1_1540909697502_3795\" style=\"font-family: Times New Roman;\">Justice Kenneth Amadi, the Presiding Judge, gave the order on Tuesday, when the state government told the court that it was prepared to challenge its judgement at the Jos Court of Appeal (COA).<\/span><u><\/u><u><\/u><\/span><\/div>\n<div id=\"m_-9135333760898547329yui_3_16_0_ym19_1_1540909697502_3797\"><\/div>\n<div id=\"m_-9135333760898547329yui_3_16_0_ym19_1_1540909697502_3799\"><span id=\"m_-9135333760898547329yui_3_16_0_ym19_1_1540909697502_3800\" lang=\"EN-US\"><span id=\"m_-9135333760898547329yui_3_16_0_ym19_1_1540909697502_3801\" style=\"font-family: Times New Roman;\">&#8220;Before a stay on the matter court could be heard, the money (N182.5M) must first be lodged in an interest yielding account.<\/span><u><\/u><u><\/u><\/span><\/div>\n<div id=\"m_-9135333760898547329yui_3_16_0_ym19_1_1540909697502_3803\"><\/div>\n<div id=\"m_-9135333760898547329yui_3_16_0_ym19_1_1540909697502_3805\"><span id=\"m_-9135333760898547329yui_3_16_0_ym19_1_1540909697502_3806\" lang=\"EN-US\"><span id=\"m_-9135333760898547329yui_3_16_0_ym19_1_1540909697502_3807\" style=\"font-family: Times New Roman;\">&#8220;You (Nassarawa State Government) must bring the money here. When you go and lose at the appellate court, the awardees will take the money, but if you win, we give shall give it back to you, \u2019\u2019 the judge stated.<\/span><u><\/u><u><\/u><\/span><\/div>\n<div id=\"m_-9135333760898547329yui_3_16_0_ym19_1_1540909697502_3809\"><\/div>\n<div id=\"m_-9135333760898547329yui_3_16_0_ym19_1_1540909697502_3811\"><span id=\"m_-9135333760898547329yui_3_16_0_ym19_1_1540909697502_3812\" lang=\"EN-US\"><span id=\"m_-9135333760898547329yui_3_16_0_ym19_1_1540909697502_3813\" style=\"font-family: Times New Roman;\">Amadi then gave the state government Nov. 19 to bring or present the cheque of the said money to the court before its motion on the intention to apply for stay of execution of the judgement of the court would be heard.<\/span><u><\/u><u><\/u><\/span><\/div>\n<div id=\"m_-9135333760898547329yui_3_16_0_ym19_1_1540909697502_3815\"><\/div>\n<div id=\"m_-9135333760898547329yui_3_16_0_ym19_1_1540909697502_3817\"><span id=\"m_-9135333760898547329yui_3_16_0_ym19_1_1540909697502_3818\" lang=\"EN-US\"><span id=\"m_-9135333760898547329yui_3_16_0_ym19_1_1540909697502_3819\" style=\"font-family: Times New Roman;\">Messrs. Paul Hammache and A.G.Yirvoms, counsels to the coaches and players respectively, had challenged the Nassarawa state government\u2019s application to move a motion for a stay of judgement as it intends to appeal at the appellate court.<\/span><u><\/u><u><\/u><\/span><\/div>\n<div id=\"m_-9135333760898547329yui_3_16_0_ym19_1_1540909697502_3821\"><\/div>\n<div id=\"m_-9135333760898547329yui_3_16_0_ym19_1_1540909697502_3823\"><span id=\"m_-9135333760898547329yui_3_16_0_ym19_1_1540909697502_3824\" lang=\"EN-US\"><span id=\"m_-9135333760898547329yui_3_16_0_ym19_1_1540909697502_3825\" style=\"font-family: Times New Roman;\">&#8220;My Lord, by the rules of this court, the Judgement Debtor Applicant, can\u2019t move any motion or be heard until and unless the amount awarded is being lodged into an interest yielding account of the court.<\/span><u><\/u><u><\/u><\/span><\/div>\n<div id=\"m_-9135333760898547329yui_3_16_0_ym19_1_1540909697502_3827\"><\/div>\n<div id=\"m_-9135333760898547329yui_3_16_0_ym19_1_1540909697502_3829\"><span id=\"m_-9135333760898547329yui_3_16_0_ym19_1_1540909697502_3830\" lang=\"EN-US\"><span id=\"m_-9135333760898547329yui_3_16_0_ym19_1_1540909697502_3831\" style=\"font-family: Times New Roman;\">&#8220;That is the rule and they must do that first before the court can hear them as it relates to the judgement and award to the coaches and players, \u2019\u2019 Yirvoms argued.<\/span><u><\/u><u><\/u><\/span><\/div>\n<div id=\"m_-9135333760898547329yui_3_16_0_ym19_1_1540909697502_3833\"><\/div>\n<div id=\"m_-9135333760898547329yui_3_16_0_ym19_1_1540909697502_3835\"><span id=\"m_-9135333760898547329yui_3_16_0_ym19_1_1540909697502_3836\" lang=\"EN-US\"><span id=\"m_-9135333760898547329yui_3_16_0_ym19_1_1540909697502_3837\" style=\"font-family: Times New Roman;\">The Judge, who concurred with Yirvoms, however, adjourned the case to Nov. 19 for lodgment of the money and hearing of the motion filed by the state government.<\/span><u><\/u><u><\/u><\/span><\/div>\n<div id=\"m_-9135333760898547329yui_3_16_0_ym19_1_1540909697502_3839\"><\/div>\n<div id=\"m_-9135333760898547329yui_3_16_0_ym19_1_1540909697502_3841\"><span id=\"m_-9135333760898547329yui_3_16_0_ym19_1_1540909697502_3842\" lang=\"EN-US\"><span id=\"m_-9135333760898547329yui_3_16_0_ym19_1_1540909697502_3843\" style=\"font-family: Times New Roman;\">Recall that the coaches and players had separately sued the state government and the club over their failure to settle their entitlements amounting to N182.5M since 2015.<\/span><u><\/u><u><\/u><\/span><\/div>\n<div id=\"m_-9135333760898547329yui_3_16_0_ym19_1_1540909697502_3845\"><\/div>\n<div id=\"m_-9135333760898547329yui_3_16_0_ym19_1_1540909697502_3847\"><span id=\"m_-9135333760898547329yui_3_16_0_ym19_1_1540909697502_3848\" lang=\"EN-US\"><span id=\"m_-9135333760898547329yui_3_16_0_ym19_1_1540909697502_3849\" style=\"font-family: Times New Roman;\">The coaches are Evans Ogenyi, Sylvester Ekoja, Michael Jatau, Bala Nikyu and El Shammah Inusa.<\/span><u><\/u><u><\/u><\/span><\/div>\n<div id=\"m_-9135333760898547329yui_3_16_0_ym19_1_1540909697502_3851\"><\/div>\n<div id=\"m_-9135333760898547329yui_3_16_0_ym19_1_1540909697502_3853\"><span id=\"m_-9135333760898547329yui_3_16_0_ym19_1_1540909697502_3854\" lang=\"EN-US\"><span id=\"m_-9135333760898547329yui_3_16_0_ym19_1_1540909697502_3855\" style=\"font-family: Times New Roman;\">The Coaches, who are now the Judgement creditors respondents along with the players, had differently served as technical adviser, assistant coach, chief coach, goal keeper trainer and chief trainer before being laid off in 2015 as the 37 players<\/span><u><\/u><u><\/u><\/span><\/div>\n<div id=\"m_-9135333760898547329yui_3_16_0_ym19_1_1540909697502_3857\"><\/div>\n<div id=\"m_-9135333760898547329yui_3_16_0_ym19_1_1540909697502_3859\"><span id=\"m_-9135333760898547329yui_3_16_0_ym19_1_1540909697502_3860\" lang=\"EN-US\"><span id=\"m_-9135333760898547329yui_3_16_0_ym19_1_1540909697502_3861\" style=\"font-family: Times New Roman;\">The two groups had approached the court through their separate Counsel, Messrs Paul Hammachi and A.G. Yirvoms.<\/span><u><\/u><u><\/u><\/span><\/div>\n<div id=\"m_-9135333760898547329yui_3_16_0_ym19_1_1540909697502_3863\"><\/div>\n<div id=\"m_-9135333760898547329yui_3_16_0_ym19_1_1540909697502_3865\"><span id=\"m_-9135333760898547329yui_3_16_0_ym19_1_1540909697502_3866\" lang=\"EN-US\"><span id=\"m_-9135333760898547329yui_3_16_0_ym19_1_1540909697502_3867\" style=\"font-family: Times New Roman;\">In their separate prayers, they had urged the court to compel the club and the state government to pay them the entitlements awarded to them by the Nigeria Football Federation (NFF) Players Status\/Arbitration Committee on Oct. 10, 2015.<\/span><u><\/u><u><\/u><\/span><\/div>\n<div id=\"m_-9135333760898547329yui_3_16_0_ym19_1_1540909697502_3869\"><\/div>\n<div id=\"m_-9135333760898547329yui_3_16_0_ym19_1_1540909697502_3871\"><span id=\"m_-9135333760898547329yui_3_16_0_ym19_1_1540909697502_3872\" lang=\"EN-US\"><span id=\"m_-9135333760898547329yui_3_16_0_ym19_1_1540909697502_3873\" style=\"font-family: Times New Roman;\">The club and the government, through their Counsel, Usman, the state\u2019s Solicitor-General, had objected to the applications and asked the court to strike them out.<\/span><u><\/u><u><\/u><\/span><\/div>\n<div id=\"m_-9135333760898547329yui_3_16_0_ym19_1_1540909697502_3875\"><\/div>\n<div id=\"m_-9135333760898547329yui_3_16_0_ym19_1_1540909697502_3877\"><span id=\"m_-9135333760898547329yui_3_16_0_ym19_1_1540909697502_3878\" lang=\"EN-US\"><span id=\"m_-9135333760898547329yui_3_16_0_ym19_1_1540909697502_3879\" style=\"font-family: Times New Roman;\">Usman had argued that the plaintiffs\u2019 application lacked merit, saying that the court also lacked jurisdiction to entertain them.<\/span><u><\/u><u><\/u><\/span><\/div>\n<div id=\"m_-9135333760898547329yui_3_16_0_ym19_1_1540909697502_3881\"><\/div>\n<div id=\"m_-9135333760898547329yui_3_16_0_ym19_1_1540909697502_3883\"><span id=\"m_-9135333760898547329yui_3_16_0_ym19_1_1540909697502_3884\" lang=\"EN-US\"><span id=\"m_-9135333760898547329yui_3_16_0_ym19_1_1540909697502_3885\" style=\"font-family: Times New Roman;\">But Justice Amadi, in his judgment, upheld the NFF\u2019s arbitration\u2019s earlier submission in the case.<\/span><u><\/u><u><\/u><\/span><\/div>\n<div id=\"m_-9135333760898547329yui_3_16_0_ym19_1_1540909697502_3887\"><\/div>\n<div id=\"m_-9135333760898547329yui_3_16_0_ym19_1_1540909697502_3889\"><span id=\"m_-9135333760898547329yui_3_16_0_ym19_1_1540909697502_3890\" lang=\"EN-US\"><span id=\"m_-9135333760898547329yui_3_16_0_ym19_1_1540909697502_3891\" style=\"font-family: Times New Roman;\">Amadi held that NFF\u2019s judgment was in order and further argued that the court had jurisdiction to adjudicate on the cases by virtue of section the\u00a0 Constitution 2010 (as amended).<\/span><u><\/u><u><\/u><\/span><\/div>\n<div id=\"m_-9135333760898547329yui_3_16_0_ym19_1_1540909697502_3893\"><\/div>\n<div id=\"m_-9135333760898547329yui_3_16_0_ym19_1_1540909697502_3895\"><span id=\"m_-9135333760898547329yui_3_16_0_ym19_1_1540909697502_3896\" lang=\"EN-US\"><span id=\"m_-9135333760898547329yui_3_16_0_ym19_1_1540909697502_3897\" style=\"font-family: Times New Roman;\">\u201cThe issues here border on employment and unpaid salaries and other entitlements.<\/span><u><\/u><u><\/u><\/span><\/div>\n<div id=\"m_-9135333760898547329yui_3_16_0_ym19_1_1540909697502_3899\"><\/div>\n<div id=\"m_-9135333760898547329yui_3_16_0_ym19_1_1540909697502_3901\"><span id=\"m_-9135333760898547329yui_3_16_0_ym19_1_1540909697502_3902\" lang=\"EN-US\"><span id=\"m_-9135333760898547329yui_3_16_0_ym19_1_1540909697502_3903\" style=\"font-family: Times New Roman;\">\u201cBy this court and by section 254 of the Constitution, it has the jurisdiction to adjudicate and to enforce any arbitrary award connected and arising from such disputes relating to non-payment of salaries, which is its exclusive right.<\/span><u><\/u><u><\/u><\/span><\/div>\n<div id=\"m_-9135333760898547329yui_3_16_0_ym19_1_1540909697502_3905\"><\/div>\n<div id=\"m_-9135333760898547329yui_3_16_0_ym19_1_1540909697502_3907\"><span id=\"m_-9135333760898547329yui_3_16_0_ym19_1_1540909697502_3908\" lang=\"EN-US\"><span id=\"m_-9135333760898547329yui_3_16_0_ym19_1_1540909697502_3909\" style=\"font-family: Times New Roman;\">\u201cThe applications filed by the state government and Nassarawa United FC have therefore failed, and I hereby adopt the NFF Players Status\/Arbitration Committee\u2019s Award as judgment for this court.<\/span><u><\/u><u><\/u><\/span><\/div>\n<div id=\"m_-9135333760898547329yui_3_16_0_ym19_1_1540909697502_3911\"><\/div>\n<div id=\"m_-9135333760898547329yui_3_16_0_ym19_1_1540909697502_3913\"><span id=\"m_-9135333760898547329yui_3_16_0_ym19_1_1540909697502_3914\" lang=\"EN-US\"><span id=\"m_-9135333760898547329yui_3_16_0_ym19_1_1540909697502_3915\" style=\"font-family: Times New Roman;\">\u201cI hereby order the respondents (Nassarawa state government and Nassarawa United FC) to pay all the awardees their entitlements in fulfillment of the award on or before April 30, 2018.<\/span><u><\/u><u><\/u><\/span><\/div>\n<div><\/div>\n<div id=\"m_-9135333760898547329yui_3_16_0_ym19_1_1540909697502_3917\"><\/div>\n<div id=\"m_-9135333760898547329yui_3_16_0_ym19_1_1540909697502_3921\" style=\"font-family: Times New Roman;\">\u201cIn the light of this, the applicants have been granted leave to enforce this judgment
