Does the National Caretaker Committee Chairman of the All Progressives Congress, Governor Maimala Buni, have the powers to orally dissolve duly appointed officials of the party at ward, Local Government and State levels by a mere pronouncement at a political rally as he did last month?
This and other questions are for the determination of a Federal High Court sitting in Gusau, Zamfara State after 10 members of the party dragged Governor Mai Mala Buni, the APC, and the Independent National Electoral Commission (INEC) before it.
They also want the Court to determine if the National Caretaker Committee Chairman has the powers to hand over the executive and structures of the party to Governor Bala Matawalle orally as he did at the rally.
Recall that Matawalle was made the leader of the APC in the troubled state after he defected from the Peoples Democratic Party (PDP) to the party last month, but two prominent members; for Governor Abdulaziz Yari, and Senator Kabiru Marafa kicked against the proclamation.
Matawalle joined the party along with all the three senators from the state, six of the seven members of the House of Representatives, and all members of the state House of Assembly.
“It is one thing we do not agree with what Governor Maimala said (Matawalle is the leader of the APC) it was not in our discussions with six governors,” Marafa said.
Senator Marafa also said that naming Governor Matawalle as the leader of the APC in Zamfara was a scam that they would not accept.
