Appeal Court declares Kogi East Senatorial District seat vacant
Two years and eight months after the general elections in Nigeria, another senatorial seat has been declared vacant by a court of appeal and the Independent National Electoral Commission (INEC) ordered to conduct fresh elections. It is the Kogi East Senatorial District seat, which joins the Anambra Central District where the election is still pending.
Effectively, Attai Aidoko, the occupier of the seat has been sent home, because the appeal court says he was not the validly elected candidate of the Peoples Democratic Party (PDP) at its primaries more than two years ago.
In his lead judgement, Justice Abdul Aboki, held that, the previous judgement of the court of appeal which brought Senator Attai Aidoko to the Senate was in error.
Former Chief of Air Staff, Air Marshall Isaac Alfa, had appealed against the judgement of court of appeal of 14th December 2016, which nullified his election and asked that Aidoko be given the seat.
